Compliance monitoring

We monitor regulated companies’ compliance with their licence obligations. 

This activity is a key focus of our work and applies to all licence types and licence holders. We want licensees to be innovative, successful, responsive to market changes, while delivering the essential energy and water services needed by all customers across Northern Ireland. 

On 10 September 2024 we published our new compliance monitoring and reporting framework which delivers an enhanced, proportionate, consistent, and effective licence compliance framework across all licence types and licence holders.

Our compliance monitoring framework includes:

1. Routine monitoring of licence compliance; and 

2. Annual assurance process known as the Statement of Licence Compliance (SoLC). 

As part of our routine monitoring processes, licensees must notify us immediately of any issues that affects their licence obligations. When a potential compliance issue has been identified, the licensee will be required to complete a compliance pro forma. This form is designed to capture the details of the issue including any impact on customers and what steps the company is taking to fix the issue so that it does not reoccur. 

The annual SoLC assurance process requires all licensees to report on their compliance status. Licensees must submit the following: 

  • An annual Statement of Licence Compliance, declaring their compliance status for each licence condition; 
  • Supplementary information related to certain conditions within the licence (if applicable); and
  • An annual assurance letter signed off at CEO/Managing Director level.
