Condition 42 was inserted into the SONI TSO licence following our review of SONI TSO’s governance arrangements.
It contains a number of implementation dates which were premised on the new SONI Board being in place by 1 June 2023.
In practice, the new board was not constituted in accordance with the requirements of Part A of Condition 42 until 1 October 2023.
Consequently, we published a notice in October 2023 proposing to modify the dates and time periods specified in Condition 42 so as to facilitate the new board having an adequate amount of time to consider and make its decisions on matters relating to implementation of Condition 42.
The effect of the proposed modification and the reasons UR proposes to modify the licence were set out in the original Article 14(2) notice.
We received one set of representations on the modifications proposed and this is published alongside this notice.
The attached Article 14(8) notice confirms our decision to modify Condition 42.
