The Utility Regulator (UR) has published an open letter to all electricity generation licence holders. The letter details the information we require where a Change of Control has occurred with respect to the licence holder.
In 2022, the UR published an Open Letter to all Electricity Generation Licence holders which specified the information that needs to be provided to the UR by Licensees alongside a Change of Control notification, to enable an assessment of the Change of Control to be undertaken.
The UR have now updated the information that must be provided alongside the notification of a Change of Control.
Annex 1 of the letter contains a list of the required information. Under Article 12 of the Energy (Northern Ireland) Order 2003, our principal objective is to protect the interests of consumers. For that reason, we reserve the right to request additional information, beyond the information specified in Annex 1, to enable us to make an ordered and properly evidenced decision in relation to a notified Change of Control.
We would encourage licence holders to familiarise themselves with all the obligations contained within the licence. It is for the licence holder to ensure they are compliant with the conditions and in the case of a Change of Control, determine whether this has occurred and notify the UR promptly.
