Utility Regulator Accepts Legally Binding Undertakings from NI Water to improve its Systems of Planning and Internal Control

Further to our receipt of responses to our consultation relating to taking potential enforcement action against NI Water on 20 November 2008, we have since received legally binding commitments from NI Water which after lengthy consideration, we have decided to accept. This acceptance therefore removes the need for the Utility Regulator to pursue and make a final enforcement order in this matter.

Under Article 31(3) of The Water and Sewerage (NI) Order 2006, the Authority is obliged to serve a notice on NIWL to indicate if it is satisfied to accept any Undertakings provided. The Article 31(3) Notice therefore signifies the Authority’s satisfaction that the Undertakings provided by NIWL are appropriate to ensure compliance with Condition F 6A.1(1)(iii) of the NI Water Licence and it is not, therefore required to make a final enforcement order. We attach the Undertakings provided by NI Water, and our acceptance notice.
